Terms of Service

The short version: Be 17 or older. Don't use Umbr to share illegal content, exploit anyone, or harm anyone. Treat the people you share with the way you'd want to be treated. We work with law enforcement on confirmed abuse.
These Terms govern your use of Umbr, an iPhone application and associated services operated by Aaratus Inc., a Delaware corporation ("Umbr," "we," or "us"). By installing, opening, or using Umbr, you agree to these Terms. If you don't agree, don't use Umbr.
1. Eligibility
You must be at least 17 years old to use Umbr. The app is rated 17+ on the App Store. By using Umbr, you represent that you meet this age requirement and that nothing in your jurisdiction prohibits you from using the service.
2. What Umbr is, and what it isn't
Umbr is an end-to-end encrypted ephemeral sharing app for photos and videos. We use cryptographic and visual techniques to make captured content significantly more resistant to screenshots, screen recordings, and camera-rephoto attempts.
No technology can make a photo 100% impossible to copy. Umbr provides strong protection against the most common forms of unauthorized capture, but we do not guarantee that your content cannot be copied, leaked, or redistributed by determined adversaries. Use Umbr accordingly.
3. Your account and identity
Umbr does not require an account, name, email, or phone number. We identify your device by a hashed local identifier. If you delete the app or use Settings → Delete Account, your data is removed from our servers.
4. Prohibited content and conduct
You may not use Umbr to create, share, request, or facilitate:
- Child sexual abuse material (CSAM) — any visual depiction of minors in sexual contexts. We report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A.
- Non-consensual intimate imagery (NCII) — including but not limited to "revenge porn," upskirting, hidden-camera footage, and sexually explicit content shared without the depicted person's consent.
- Threats, harassment, doxxing, or stalking — content intended to threaten, harm, intimidate, or expose private information about another person.
- Content that promotes terrorism, violent extremism, or hate-motivated violence.
- Copyright or trademark infringement — content you do not have the right to share.
- Illegal content — anything unlawful in either the sender's or recipient's jurisdiction, including illegal narcotics offers, weapons trafficking, or fraud.
- Spam, phishing, or malware delivery.
You also agree not to:
- Reverse-engineer, decompile, or attempt to bypass Umbr's protections.
- Probe, scan, or attempt to access tokens or shares that were not sent to you.
- Use Umbr to scrape, train AI on, or otherwise systematically extract content.
- Resell, sublicense, or commercialize Umbr without our written permission.
- Use Umbr in any way that violates applicable export controls, sanctions, or other laws.
5. Reporting and enforcement
Every Umbr viewer (in-app and web) includes a one-tap Report button. Reported shares are immediately disabled for everyone and flagged for our review. We commit to responding to safety reports within 24 hours.
We may, at our discretion and consistent with applicable law:
- Disable any share at any time, with or without notice.
- Restrict or terminate access for any device that violates these Terms.
- Preserve and disclose information to law enforcement, courts, NCMEC, or similar authorities when legally required or when we believe it is necessary to prevent harm.
Repeat offenders may be permanently banned from creating new shares.
6. Encryption and your responsibility
Umbr is end-to-end encrypted. We cannot read, preview, or pre-screen content you send. This means content moderation occurs only in response to user reports and post-incident review of reported encrypted material via legal process. By using Umbr, you accept that you are responsible for what you choose to send and whom you choose to send it to.
7. Photosensitivity
Umbr's protected content uses rapid frame alternation (up to 120 frames per second on ProMotion displays). If you have photosensitive epilepsy, sensitivity to flicker, or any related condition, this app may not be safe for you. Stop using Umbr immediately and consult a medical professional if you experience any discomfort. Users on iOS with Reduce Motion enabled receive a single static frame instead of alternation, with reduced protection.
8. Intellectual property
Umbr, the Umbr name, logo, "SmartPhotos™" and "SmartVideos™" trademarks, and the underlying software are owned by Aaratus Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these Terms.
You retain all rights in the photos and videos you create. By using Umbr to deliver content, you grant us a narrow, time-limited license to host the encrypted blob and its metadata solely for the purpose of delivering it to your chosen recipients.
9. Disclaimers
Umbr is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or perfectly secure. Some jurisdictions don't allow these disclaimers; in those jurisdictions our warranties are limited to the minimum the law requires.
10. Limitation of liability
To the maximum extent permitted by law, Aaratus Inc. and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of Umbr. Our total aggregate liability for any claim arising out of these Terms or your use of the service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim, or (b) US$50.
11. Indemnity
You agree to defend and indemnify Aaratus Inc. against any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the service.
12. Termination
You can stop using Umbr and delete your data at any time via Settings → Delete Account. We can suspend or terminate your access if you violate these Terms or if we are required to by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, dispute resolution) survive.
13. Changes
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where significant, surfaced in the app. Continued use after a change means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms must be brought in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
